Terms of service

These Terms of Service apply to every order you place with K-pop Escape, operated by Stay Escape, a sole proprietorship established in the Netherlands. You can read, save and print them before you order, and we send them with your order confirmation. Mandatory consumer rights always take priority where they give you greater protection.

A consumer is a person who buys for purposes outside their trade, business or profession. The right of withdrawal, the legal guarantee as described in our Refund policy and the other consumer protections in these terms apply to consumers. Business buyers have the rights that the general law gives them.

Products and availability

We sell K-pop albums, photocards, pre-order benefits, collector items and selected merchandise. Stock may be limited or unique. Product pages state the version, member, condition and included items where relevant. Random inclusions, member versions, pre-order benefits or retailer exclusives are included only when expressly stated.

Orders and contract

The purchase contract is formed when you complete checkout and we confirm the order by email. Please check the confirmation and tell us promptly about any mistake. Most of our items exist only once. If an item turns out to be unavailable, for example because it was sold twice at the same moment, or if a listing contained an obvious error such as a plainly wrong price, we tell you as soon as possible, cancel that item and refund what you paid for it without delay and at the latest within 14 days.

Prices, VAT and import charges

Prices are shown in euros. For deliveries within the European Union they include VAT. Shipping costs are shown separately at checkout, and the total shown at checkout before you pay is the total we charge.

For deliveries within the European Union there are no import charges on delivery. The only exception is a small number of special territories that are outside the EU VAT or customs area, such as the Canary Islands, Ceuta, Melilla, the Åland Islands and the French overseas departments, where local import charges can apply. For deliveries outside the European Union, the destination country may charge import VAT, customs duty and a carrier handling fee. Those charges are not included in our prices, are collected by the carrier or customs, and are payable by the recipient unless checkout expressly states that they are included. Photocards may qualify for duty-free treatment as printed material in some countries, but local taxes or carrier fees may still apply. We do not undervalue goods or mark commercial orders as gifts.

Payment

Available payment methods appear at checkout. Payment must be authorised before dispatch. Payment providers may apply their own terms and security checks.

Shipping and delivery

We ship from the Netherlands to the destinations that can be selected at checkout. We hand orders to the carrier within 1–2 business days after payment; carrier transit time comes on top of that. Rates, delivery estimates, address responsibilities and customs information are set out in our Shipping policy.

Your order must reach you within 30 days after you placed it, unless we agreed a different period with you. If it does not, you may cancel the order and we refund everything you paid without delay. The risk of loss or damage passes to you when you, or a person you designated who is not the carrier, have received the goods.

Condition, authenticity and inclusions

Known defects, missing inclusions and relevant condition details are disclosed in the listing. We use the term “official” only when we have reasonable evidence of official manufacture or distribution; unofficial or fan-made items are labelled as such.

Cancellations, returns, refunds and legal guarantee

Our Refund policy forms part of these terms. It explains the 14-day right of withdrawal, how to withdraw, the model withdrawal form, refund timing and the legal guarantee of conformity. Nothing in these terms excludes your legal rights relating to defective, damaged, incorrect or non-conforming goods.

Intellectual property and affiliation

Store text, photography and design may not be copied or commercially reused without permission, except where the law permits. Artist names, group names, logos, album artwork and other trademarks belong to their respective owners. K-pop Escape is an independent retailer and is not affiliated with, endorsed by or sponsored by any artist, label or agency unless a product page explicitly states otherwise.

Acceptable use

You must not misuse the website, attempt unauthorised access, submit false information, infringe third-party rights or use the service for unlawful or fraudulent purposes.

Liability

We are liable to consumers in accordance with the law, and nothing in these terms limits that liability or your rights under the legal guarantee. We are not liable for damage caused by circumstances outside our reasonable control, to the extent the law does not hold us responsible for them. If you buy in the course of a business or profession, our liability is limited to the amount you paid for the order concerned, except in cases of intent or deliberate recklessness.

Complaints, governing law and disputes

If you have a complaint, email stayescape99@gmail.com with your order number. We respond as soon as reasonably possible on business days and try to resolve the issue with you directly. These terms are governed by Dutch law. If you are a consumer, this choice does not deprive you of the mandatory protections of the country where you live. You may also bring a dispute before any competent court or use any legally available alternative dispute-resolution route.

Privacy and Shopify Enhanced Services

Our store uses Shopify Network Intelligence and Enhanced Services. Shopify may combine personal data collected through this store with data from your interactions with other merchants and Shopify services to improve the shopping experience, including personalisation and advertising-related features, subject to your privacy choices. Changes and contact

We may update these terms for future orders. The version in force when you place an order applies to that order.
